purpose

these terms govern your use of the émo messenger mobile application, the emomessenger.com website, and all related services operated by 3.2.1 émotion inc. by accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these terms.

acceptance

by creating an account, downloading the app, or using our services, you agree to comply with and be bound by these terms. if you do not agree with any part of these terms, you should not use our services.

eligibility

émo messenger is available to users aged 16 and older. by using our services, you confirm that you are at least 16 years old. we verify age during the sign-up process.

our services

émo messenger provides:

an emotional messaging platform — craft and send emotions to your connections
social features — connect with others, build emotional relationships
ai-powered features — content assistance and safety filtering
gamification — badges, streaks, and feature unlocks

we may update, modify, or discontinue features at our discretion. we will notify you of significant changes.

your account

when you create an account, you agree to:

provide accurate and truthful information
keep your account credentials secure
notify us immediately of any unauthorized use
not create multiple accounts or impersonate others

you are responsible for all activity that occurs under your account.

acceptable use

when using émo messenger, you agree not to:

send harassing, threatening, or harmful content
use the service for unlawful purposes
attempt to access other users' accounts or data
reverse engineer, decompile, or tamper with the app
use automated systems or bots to interact with the service

we reserve the right to suspend or terminate accounts that violate these terms.

your content

you retain ownership of the emotional messages and content you create. by using our service, you grant us a limited license to store, transmit, and display your content solely for the purpose of delivering the service to you and your connections.

we do not claim ownership of your content. we do not use your content for advertising or sell it to third parties.

intellectual property

all branding, design, code, the .emo format, feelmoji, and the émo messenger name are the exclusive property of 3.2.1 émotion inc. they are protected by united states and international intellectual property law.

ai features

émo messenger uses third-party ai services (anthropic, replicate) for content assistance and safety filtering. ai-generated content is provided as-is and may not always be accurate. you are responsible for reviewing any ai-assisted content before sharing it.

data protection

we take your privacy seriously. please refer to our privacy policy for detailed information on how we collect, use, and protect your personal data.

account deletion

you can delete your account at any time from the app settings. upon deletion, your data enters a 30-day cooling-off period, after which all personal data is permanently and irreversibly removed from our systems.

limitation of liability

our services are provided "as is" and "as available" without warranties of any kind, whether express or implied. 3.2.1 émotion inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services.

modifications

we reserve the right to modify these terms at any time. changes will be posted on this page with an updated revision date and communicated through the app. your continued use of our services after any changes constitutes acceptance of the new terms.

governing law

these terms are governed by and construed in accordance with the laws of the state of new york, united states. any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of new york city.
